By logging in to Steelbiz you continue to acknowledge and accept these Terms and Conditions which you agreed upon when first registering.
1.1 “Agreement” means this licence agreement between us and you;
1.2 “Guest Users” are any persons not employed by an SCI Member Organisation;
1.3 “Authorized Users” are employees of an SCI Member Organisation;
1.4 “Member Organisation” means an SCI Corporate Member or Sole Trader Member;
1.5 “Steelbiz™” means this communication media service;
1.6 “we” and “us” means The Steel Construction Institute (SCI) and “our” means SCI’s;
1.7 “you” means the customer with whom we make this Agreement.
These Terms and Conditions and the documents referred to in them set out the entire agreement between you and us for access to Steelbiz™.
2.1 Steelbiz™ is an information service provided by SCI under the terms and conditions of this Agreement and starting on the date on which you register by completing the online registration and accepting these terms.
2.2 This Agreement permits simultaneous access to Steelbiz™ by Authorized Users by virtue of their SCI membership.
2.3 Access to Steelbiz™ may not be transferred or extended to others. Each user of Steelbiz™ must individually register on the Steelbiz™ site.
2.4 It is technically impractical to guarantee to provide Steelbiz™ fault free and we do not do so. However, we will make reasonable endeavours to rectify faults identified by us or reported to us.
2.5 It is your responsibility to comply with all reasonable instructions we may give relating to the use of Steelbiz™.
2.6 You are responsible for providing items of hardware, software and communications or any other equipment necessary to access Steelbiz™.
2.7 Steelbiz™ is most likely to function as intended if accessed using the following web browsers: MS Internet Explorer version 9 or later, Firefox version 18.0 or later, Google Chrome version 17.0 or later. Use of the website may also be possible using other or earlier versions of these browsers (or different browsers) but in this instance the full or intended functionality may not be available. A compatible PDF reader is required for viewing most of the information resources available via the website.
3.1 To access information resources Steelbiz™, you require a valid user account.
3.2 You are required to provide certain personal data, including an email address, during the registration process. Following confirmation of your employer’s SCI membership details, employees of SCI Member Organisations will be entitled to access all information resources accessible within Steelbiz™. Each member employee is required to register individually. The total number of Authorized Users at any one time must be reasonable for the size of the Member Organisation. Access to member-only resources within Steelbiz remains valid whilst the Member Organisation remains in membership of SCI and the Authorized Users remains in employment of the Member Organisation.
3.3 Should a Corporate or Sole Trader Member resign from membership, all access to member-only resources within Steelbiz for it’s employees shall be revoked.
3.4 All users are responsible for notifying SCI of any changes to their individual or company contact details.
3.5 SCI reserves the right to withdraw access rights where abuse of the Steelbiz™ service is detected.
4.1 Authorized Users may view and print hard copy of information resources accessed within Steelbiz™ for their personal use. Copying must be limited to making single copies of a reasonable number of individual items. Brief quotations may be made from the content of any online information resource provided the customary acknowledgement of source is made and subject to clause 6. The same usage is permitted for Guest Users excepting that viewing and printing of member-only information resources is not permitted and the ability to print certain information resources is disabled.
5.1 The Member Organisation will use its best endeavours to ensure that no unauthorized access or use occurs through its SCI membership. The Member Organisation will make every effort to enforce these terms on receiving information that reasonably indicates that they are being violated.
5.2 You are responsible for the security and proper use of your Steelbiz™ password and must take all necessary steps to ensure that it is kept confidential and used properly. The acccess permitted via either a registered Guest User or Authorised User account is not transferable. Should you have any reason to believe that the password has become known to an unauthorised person or it is likely to be used in an unauthorised way you should immediately notify us.
5.3 If anyone other than you uses your password to gain access to any of the Steelbiz™ services with or without your knowledge or approval, we can treat the contravention as a breach by you of this Agreement and can terminate it forthwith or suspend the Steelbiz™ service or any part of the Steelbiz™ service to you.
5.4 You are responsible for notifying us of any changes to user details.
5.5 We will use reasonable endeavours to protect your data against unauthorised access by any third party. You should be aware that no encrypted method (SSL access) for logging-in to Steelbiz is provided. Although the risk of unauthorised access is low, it is recommended that take reasonable precautions to prevent misuse of your account login details and do not store any information you consider to be confidential when registering. We do not accept liability for loss, corruption or unauthorised use of your confidential information by third parties.
6.1 Most of the technical information that is available on Steelbiz™ is protected by copyright. Guest User and Authorised Users are permitted to use the copyright information to which they have access for the purposes of research, private study, criticism or review, as permitted under the Copyright Designs and Patents Act, 1988. Transmission (or forwarding) of any data from Steelbiz™ by electronic or any other means to third parties is strictly forbidden. Copying or pasting any “facsimile” text into other documents in not allowed without prior permission. Enquiries concerning reproduction outside these terms should be addressed to SCI by emailing publications@steel-sci.com.
6.2 No part of Steelbiz™ may be permanently copied or reproduced in any form or reproduced on any other website or stored in or transmitted to or from any electronic or digital form in whole or in part.
6.3 Intellectual property rights in the Steelbiz™ software and any software, documentation or design supplied by us to you through Steelbiz™ remain our property or that of our licensors.
6.4 Subject to the terms of this Agreement, we grant you the non-exclusive right to use such software, documentation or design in connection with the Steelbiz™ service.
6.5 Without affecting any applicable statutory rights under the Copyright (Computer Program) Regulations 1992, or any enactment thereof, you must not, nor may you permit any other person to disassemble, reverse engineer, de-compile or in any other way interfere with the software nor copy or modify the software nor create any new software partly or wholly based on the software.
7.1 Although care has been taken to ensure, to the best of our knowledge, that all data and information provided through Steelbiz™ are accurate to the extent that they relate to either matters of fact or accepted practice or matters of opinion at the time of publication, SCI assumes no responsibility for any errors in or misinterpretations of such data and/or information or any loss or damage arising from or related to their use.
7.2 Links within Steelbiz™ may lead to other sites. We do not sponsor, endorse or otherwise approve of any information or statements appearing in those sites, nor in sites referred to in or linked to those sites.
7.3 Whilst we exercise a degree of selection in choice of third party information available on Steelbiz™, we accept no liability for such third party information in any jurisdiction that would or could arise from or as a result of reliance on the content of this information.
7.4 We will not be liable for any loss of, or damage to, any data or computer program caused by your use of Steelbiz™ or other material accessible through Steelbiz™.
7.5 We take some precautions to detect viruses and other harmful code which may be introduced into Steelbiz™. However, you are responsible for using your own procedures for detecting these and for protecting your systems and information against them, and you agree to do so and that we will not have any liability for any loss or damage caused by any virus or other harmful code.
7.6 We are not liable to you either in contract, tort (including negligence) or otherwise for loss (whether direct or indirect) of profits, business or anticipated savings, loss or destruction of data or for any indirect or consequential loss whatsoever.
7.7 Steelbiz™ is a service that is under continuous development. We do not accept any liability for the use to which you put the Steelbiz™ service.
8.1 We may obtain information about you from your use of Steelbiz™. This information will be collected by us while you are connected to Steelbiz™, and it may possibly be accessed by third parties while you are connected to other sites. We may store this information for our own purposes, which may include contacting you with information that we believe may be of interest to you and for marketing our products and services to you.
8.2 You agree to provide only information that is true and accurate.
9.1 You hereby agree to indemnify and hold us harmless from any loss suffered by us as a result of your breach of the terms and conditions of this Agreement. You shall pay all costs, damages, awards, fees (including reasonable legal fees) and judgements awarded against us arising from such a breach.
10.1 This Contract is governed by English Law and you and we submit to the exclusive jurisdiction of the English courts.
